1. Overview
These Terms of Service (“Terms”) govern your access to and use of the Garden Built website and any purchases made through Garden Built. Garden Built is an online retail brand owned and operated by A Lovesome Garden L.L.C.

By accessing the website, submitting an order, or otherwise using Garden Built’s services, you agree to these Terms together with the policies made available on the website. Nothing in these Terms is intended to waive or limit any consumer right that cannot lawfully be waived or limited under applicable law.

Garden Built operates exclusively as an online retailer.
The address above is used for business and administrative purposes only. Garden Built does not provide walk-in shopping, customer pickup, or in-person retail services at this location.
Customers must not send product returns to this address unless specifically instructed to do so by Garden Built customer support.
3. Eligibility & Legal Capacity
You may place an order through Garden Built only if you have the legal capacity to enter into a binding contract under the laws applicable to you.
If you have not reached the age of legal majority in your jurisdiction, purchases should be made only with the involvement and authorization of a parent or legal guardian.
You are responsible for providing accurate and complete information when using the website or placing an order.
4. Permitted Use of the Website
You may use the Garden Built website only for lawful purposes.
You must not use the website to engage in fraud, provide intentionally false order or payment information, interfere with the operation or security of the website, introduce malicious code, attempt unauthorized access to systems or accounts, misuse website content in violation of applicable law, or engage in conduct that violates applicable laws or the rights of another person.
Garden Built may restrict access to the website when reasonably necessary to protect the website, customers, payment systems, or business operations from fraudulent, abusive, unlawful, or harmful activity.
5. Products & Product Information
Garden Built offers gardening tools, equipment, accessories, growing supplies, and related products.
We aim to present product information accurately based on information verified or reasonably available for each individual product.
Product-specific information may include dimensions, materials, specifications, features, intended uses, available variations, and other relevant details.
Garden Built does not claim to manufacture a product unless the applicable product is actually manufactured by Garden Built or A Lovesome Garden L.L.C.
Claims relating to manufacturing origin, “Made in USA” status, certification, materials, performance, safety, environmental benefits, medical or health benefits, brand affiliation, warranty, authenticity, or similar characteristics should only be considered applicable when specifically stated and verified for the individual product.
6. Product Availability
Product availability may change without notice.
Because Garden Built uses distributed third-party fulfillment, inventory availability may depend on the applicable product, fulfillment partner, inventory location, and delivery destination.
If Garden Built is unable to fulfill an ordered item, the customer will be notified and an appropriate resolution will be provided in accordance with applicable law and the circumstances of the order.
7. Pricing & Currency
Product prices are displayed primarily in U.S. dollars (USD).
The applicable product price will be displayed before the customer completes payment.
Shipping charges and other mandatory charges applicable to the transaction will be disclosed before payment is completed.
Customers should review the final order total displayed during checkout before submitting payment.
Any sale, discount, or promotional price displayed by Garden Built is intended to represent the applicable offer available at that time.
8. Payment
Garden Built uses PayPal as its payment processor.
Depending on PayPal availability, customer location, eligibility, and checkout configuration, available payment methods may include PayPal Balance, Visa, Mastercard, American Express, Discover, or other eligible payment methods made available through PayPal.
The availability of a particular payment method is determined through the PayPal checkout process.
Garden Built does not represent that every payment method or payment card is available to every customer.
9. Order Submission & Acceptance
When you submit an order, you are requesting to purchase the products identified in your order using the information provided during checkout.
Order submission does not mean that an order has already been shipped or fulfilled.
Garden Built may contact a customer when additional information is reasonably required to review or process an order.
If an order cannot be fulfilled, Garden Built will handle the affected transaction in accordance with applicable law and the applicable refund procedures.
10. Order Processing
Garden Built processes orders on business days, Monday through Friday.
Order Cut-Off Time: 5:00 PM Mountain Time (MT)
Processing Time: 1–4 business days
Orders placed before 5:00 PM MT may begin processing on the same business day.
Orders placed after 5:00 PM MT, on weekends, or on applicable holidays will begin processing on the next business day.
Processing time is separate from shipping or transit time.
11. Customer-Requested Cancellation
Customers may request cancellation within 12 hours after placing an order.
Cancellation requests must be sent to:

Please include the applicable order number.
After the 12-hour customer-requested cancellation window, cancellation cannot be guaranteed because the order may already have entered processing or fulfillment.
If an order has already been processed or shipped, Garden Built generally cannot cancel it through the standard voluntary cancellation process.
This 12-hour policy does not limit any cancellation, refund, delayed-shipment, or other consumer rights that may apply under applicable law.
12. Shipping Delays & Applicable Consumer Rights
Garden Built intends to ship orders within the timeframes represented on the website based on a reasonable expectation that those timeframes can be met.
If Garden Built becomes unable to ship an order within an applicable represented shipping timeframe, Garden Built will handle the delay in accordance with applicable law.
Where required, the customer may be notified of the delay and provided an opportunity to agree to a revised shipping timeframe or cancel the affected order and receive an applicable refund.
Nothing in Garden Built’s voluntary 12-hour cancellation policy eliminates rights a customer may have when merchandise cannot be shipped within an applicable promised timeframe.
13. Fulfillment Model
Garden Built uses a distributed third-party fulfillment model.
Depending on product availability, inventory location, customer delivery address, shipping efficiency, and fulfillment partner availability, orders may be fulfilled from locations in the United States or internationally.
Garden Built does not guarantee that every order will ship from the United States.
Products may be shipped directly to customers by third-party fulfillment partners.
Orders containing multiple products may be fulfilled from different locations and may arrive in separate packages.
14. Shipping & Delivery Estimates
For orders shipped within the United States:
Processing Time: 1–4 business days
Estimated Transit Time: 4–10 business days
Estimated Total Delivery Time: 5–14 business days
For international orders:
Processing Time: 1–4 business days
Estimated Transit Time: 4–15 business days
Estimated Total Delivery Time: 5–19 business days
Delivery estimates are expressed in business days unless otherwise stated.
Actual delivery times may vary due to carrier delays, customs processing, weather conditions, holidays, remote delivery locations, incorrect customer address information, or other circumstances outside Garden Built’s reasonable control.
Unless a specific shipping service expressly provides a guaranteed delivery date, delivery dates displayed by Garden Built are estimates rather than guarantees.
Nothing in this section limits rights that may apply when an order is not shipped within a legally applicable or represented timeframe.
15. Shipping Costs
Shipping charges may depend on the product, package weight, package dimensions, delivery destination, shipping method, and fulfillment location.
Applicable shipping charges will be displayed during checkout before the customer completes payment.
Garden Built does not make a universal free-shipping commitment unless a specific free-shipping offer or threshold is clearly disclosed and actually available for the applicable transaction.
16. Shipping Carriers
Depending on fulfillment origin, destination, and product availability, shipping carriers may include USPS, DHL, DHL Parcel, YunExpress, Yanwen, Canada Post, Australia Post, or other qualified domestic, regional, or local last-mile providers.
The carrier used for a particular order may vary.
Garden Built does not guarantee the use of a specific carrier unless expressly stated for the applicable order.
17. International Orders, Customs & Duties
International orders may be subject to customs processing, import duties, taxes, local fees, or other charges imposed by the destination country.
Any applicable customs duties, taxes, or import-related charges that are not collected during checkout may be the customer’s responsibility, subject to applicable law.
Garden Built does not control customs processing times or charges imposed by foreign governments or local authorities.
18. Order Tracking
Once an order has shipped and tracking information becomes available, Garden Built will provide relevant tracking details.

Tracking information may take additional time to update after the shipment has been handed over to the applicable carrier.
19. Split Shipments
Orders containing multiple products may ship from different fulfillment centers, ship at different times, arrive in separate packages, or have separate tracking numbers.
A customer may therefore receive more than one delivery for a single order.
20. Delivery Information
Customers are responsible for providing accurate and complete shipping information during checkout.
Incorrect or incomplete address information may cause delivery delays or other delivery problems.
Nothing in this section limits any responsibility Garden Built has under applicable law for matters attributable to Garden Built or its fulfillment partners.
21. Limited Return & Refund Policy
Garden Built maintains a limited return and refund policy.
Garden Built does not generally accept returns solely because a customer changes their mind, no longer wants or needs the product, ordered unintentionally, or finds a different product elsewhere.
Customers may report eligible issues where a product arrives damaged, arrives defective, is materially different from the item ordered, is the incorrect product, contains missing components due to a fulfillment error, or has another verified fulfillment-related issue attributable to Garden Built or its fulfillment partners.
This policy does not limit any non-waivable return, refund, warranty, or consumer protection right provided by applicable law.
22. 14-Day Problem Reporting Window
Customers should report eligible damaged, defective, incorrect, or fulfillment-related issues within 14 days after delivery.

Customers should provide the applicable order number, a description of the issue, clear photographs showing the problem, and additional photos or videos when reasonably required for verification.
The 14-day period is Garden Built’s standard problem-reporting window for eligible order issues and is not a general buyer-remorse return period.
Nothing in this provision shortens a statutory period or other right that cannot lawfully be shortened by these Terms.
23. Return Authorization & Return Shipping
Customers should not independently return an item before receiving instructions from Garden Built.
A physical return is not required in every case.
If Garden Built determines that a return is necessary, customer support will provide the applicable return instructions.
For verified defective, damaged, incorrect, or fulfillment-error cases attributable to Garden Built or its fulfillment partners, the customer will not be required to pay return shipping costs when Garden Built requires the product to be returned.
Do not send returns to Garden Built’s administrative address unless specifically instructed to do so.
24. Replacements
After verification of an eligible issue, Garden Built may provide a free replacement when appropriate and product availability permits.
Replacement Processing Time: approximately 1–4 business days
Estimated Replacement Shipping Time: approximately 4–15 business days
Timing may depend on destination and fulfillment origin.
Tracking information will be provided when available.
25. Refunds
Approved refunds will be issued to the customer’s original payment method whenever possible.
Garden Built Processing Time: 1–5 business days after approval
Bank or Payment Provider Posting Time: approximately 3–7 additional business days
Actual posting times may depend on the customer’s bank, card issuer, or payment provider.
These standard processing estimates do not override a shorter refund deadline that may be required by applicable law for a particular transaction.
26. Exchanges
Garden Built does not provide traditional exchanges based solely on buyer preference or change of mind.
For verified defects, shipping damage, incorrect products, missing components, or other eligible fulfillment errors, Garden Built may provide an approved replacement at no additional cost.
27. Third-Party Services
Garden Built relies on third parties for certain business operations, including PayPal for payment processing, third-party fulfillment partners, and shipping or last-mile delivery providers.
These service providers may maintain their own terms, policies, eligibility requirements, and operating procedures.
Garden Built is not authorized to modify the independent terms of a third-party provider.
Nothing in this provision excludes responsibility that Garden Built cannot legally exclude for its own obligations to customers.
28. Intellectual Property
The Garden Built name, branding, website design elements, original written content, and other materials created by or for A Lovesome Garden L.L.C. are protected to the extent provided by applicable intellectual property law.
Certain product images, descriptions, trademarks, logos, or other materials may belong to manufacturers, suppliers, fulfillment partners, service providers, or other rights holders and may be used where Garden Built has an appropriate right or basis to use them.
You may not copy, reproduce, republish, distribute, commercially exploit, or create unauthorized derivative works from protected Garden Built website content except where permitted by law or with appropriate permission from the applicable rights holder.
29. Trademarks & Third-Party Brands
References to third-party trademarks, payment brands, carriers, manufacturers, or product brands are used only where relevant to describing products or services.
Such references do not by themselves imply sponsorship, ownership, authorization, endorsement, or affiliation unless that relationship is expressly stated and verified.
30. Website Accuracy
Garden Built aims to keep website information accurate and current.
However, typographical errors, technical errors, product-data errors, or outdated information may occasionally occur.
When Garden Built discovers a material error affecting an order, price, product description, or fulfillment expectation, Garden Built will take reasonable steps to correct the information and address affected orders in accordance with applicable law.
Garden Built will not knowingly rely on this clause to honor misleading or deceptive product, pricing, or transaction information.
31. No Unsupported Product Warranties
Garden Built does not make product warranties, certifications, origin representations, performance guarantees, or similar claims unless they are specifically stated and supported for the applicable product.
Nothing in these Terms excludes an express warranty actually provided for a particular product or any warranty or consumer right that cannot legally be excluded.
32. Disclaimer of Additional Warranties
To the fullest extent permitted by applicable law, Garden Built does not provide warranties or representations beyond those expressly stated for a particular product, transaction, or service.
The website and related information are provided for the purpose of facilitating Garden Built’s online retail operations.
This section does not exclude or limit any statutory warranty, consumer guarantee, product-liability obligation, or other right that applicable law does not permit Garden Built to exclude or limit.
33. Limitation of Liability
To the fullest extent permitted by applicable law, A Lovesome Garden L.L.C. and Garden Built will not be liable for indirect, incidental, special, or consequential losses arising solely from use of the website or a transaction where such losses may legally be excluded.
Where applicable law permits a contractual limitation of direct monetary liability, Garden Built’s aggregate contractual liability arising from a particular product transaction will not exceed the amount actually paid by the customer for the product giving rise to the claim.
This limitation does not apply to liability that cannot legally be excluded or limited, including where applicable liability arising from fraud, willful misconduct, gross negligence, personal injury, or mandatory consumer protection obligations.
34. Events Outside Reasonable Control
Weather events, carrier interruptions, customs delays, transportation disruptions, governmental actions, natural disasters, and other events outside Garden Built’s reasonable control may affect fulfillment or delivery.
Garden Built will not treat this provision as eliminating customer rights that arise under applicable law when an order is delayed, cannot be shipped, or must be refunded.
35. Privacy
Information associated with website use, customer orders, payments, fulfillment, delivery, and customer support is handled in accordance with the Garden Built Privacy Policy and the practices applicable to third-party service providers involved in the transaction.
Customers should review the Privacy Policy available on the Garden Built website.
36. Governing Law
Except where mandatory consumer protection law requires otherwise, these Terms and contractual matters arising from them will be governed by the laws of the State of Colorado, United States, without regard to conflict-of-law principles that would require application of another jurisdiction’s law.
Nothing in this provision deprives a customer of protections under mandatory laws that apply to the customer and cannot legally be waived by contract.
37. Jurisdiction & Venue
Subject to any mandatory right a consumer may have to bring a claim in another jurisdiction, disputes arising from these Terms or transactions with Garden Built may be brought in the applicable state or federal courts serving Jefferson County, Colorado.
The parties consent to the jurisdiction of those courts to the extent such consent is legally effective.
38. No Mandatory Arbitration Clause
These Terms do not currently require customers to resolve disputes through mandatory binding arbitration and do not currently contain a class-action waiver.
Any future adoption of an arbitration or class-action provision should be separately disclosed and reviewed for compliance with applicable law before becoming effective.
39. Severability
If any provision of these Terms is determined by a court or other competent authority to be invalid, unlawful, or unenforceable, that provision will be applied to the maximum extent legally permitted or severed where necessary.
The remaining provisions will continue in effect to the extent permitted by law.
40. No Waiver
If Garden Built does not immediately enforce a provision of these Terms, that does not necessarily constitute a permanent waiver of the right to enforce that provision later.
Any waiver must comply with applicable law.
41. Entire Agreement
These Terms, together with the applicable Garden Built policies and transaction-specific information presented during checkout, form the terms applicable to the customer’s use of the website and purchase transaction, subject to any rights that cannot legally be modified by contract.
If product-specific or transaction-specific information conflicts with a general statement in these Terms, the more specific information should apply to that particular product or transaction unless doing so would violate applicable law.
42. Changes to These Terms
Garden Built may update these Terms to reflect changes in its operations, policies, services, or applicable legal requirements.
Changes should be published on this page before being applied to future transactions.
Changes to these Terms do not retroactively remove rights that have already arisen under an existing transaction or applicable law.
